Example #15 ---- 11/14 Hour Rule Violation

Ok, I messed up on my log and realize that I have an 11 or 14 Hour Rule Violation, "What to I need to do to become legal again?

 

THIS LOG IS IN VIOLATION

Once a violation has occurred and discovered there are two possible way to again become in compliant with the rules.

CVSA Handbook Dated January 1, 2004 Appendix A NORTH AMERICAN STANDARD OUT-OF-SERVICE CRITERIA States:

(pg5)  *9.DRIVERS RECORD OF DUTY STATUS - US/MEXICO

a. Property-Carrying Vehicle (395.3)

    (1) 11 Hour Rule (See footnotes 1,3,4)

    Driving more than eleven (11) hours following ten(10) consecutive hours off duty. (395.3(a)(1)) Place driver Out-of-Service for ten (10) consecutive hours.

   (2) 14 Hour Rule (See footnotes 1,3,4,5)

   Driving beyond the fourteenth (14) hour after coming on duty following (10) consecutive hours off duty. (395.3(a)(2)) Place driver Out-of-Service for ten (10) consecutive hours.

(pg7) FOOTNOTES FOR DRIVER'S RECORD OF DUTY STATUS - US/MEXICO

1. Sleeper Berth Operations (395.1(g))

    (a) Divers involved in sleeper berth operations (sleeper teams) placed Out-of-Service for Hours" violations may be replaced by a co-driver, if the co-driver has hours available to drive.

    (b) A solo driver using a sleeper berth to obtain rest who exceeds the hours of service limitations shall be placed Out-of-Service until said driver has hours available to drive.

3. Drivers must comply with the hours of service rules of the country (Canada, United States or Mexico) that the driver is operating (driving) in.

4. Drivers operating in the State of Alaska (395.1(h)).

    (a) Property-Carrying CMV-15 hours driving time and 20 hours on duty time following 10 hours off duty. 70 hours in 7 consecutive days, and 80 hours in 8 consecutive days.

    (b) Passenger-Carrying CMV-15 hours driving time and 20 hours on duty time following 8 hours off duty. 70 hours in 7 consecutive days, and 80 hours in 8 consecutive days.

5. Exception (395.1(o)). A property-carrying driver is allowed one 16 hours on duty day within the current 7 or 8 consecutive day period provided the driver has returned to the driver's normal work reporting location and the carrier released the driver from duty at that location for the previous five duty tours the driver has worked.

DDL NOTE:  What it comes down to is that the inspecting officer can go by the above or can put you out-of-service for 10 hours.  DDL default is the 10 hours off. To change this setting go to EDIT-SETTINGS-AUDIT SETTINGS-then take the check mark out of "Use CVSA 10 Hours Off Duty OOS for Split Sleeper Violations"
