Example #9 ----14 Hour Rule (Multiple Sleepers)

THIS IS A LEGAL LOG

In this example the driver took multiple sleepers, DDL will analyze and exclude the best sleeper in calculating the 14 hour rule.  Thus giving the driver the best extension, Doing this will allow the driver the best combination to maximize his driving. In this case the sleeper from 11:15 AM to 2:00 PM is best.

NOTE1: One of the interesting things that FMCSA did with the new rules was to require an officer to assume that the driver was going to do the right thing.  In the example above, all the officer sees is the 5 sleeper berths. No two equal 10 hours. Yet the driver has not broken any rule "How can this be?"  Answer: The sleeper that starts at 6:45 PM goes past midnight into Day 2 and when added to the sleeper from 11:15 AM to 2:00 PM equals 10 or more hours. Should the driver not get the required 2nd sleeper berth, then the extension would be invalid and a violation would occur at 4:00 PM the original 14 hour point.

An excluded sleeper is valid until the driver violates the exclusion by not receiving the required 2nd sleeper berth, that when added to the first equals 10 or more hours. This can not be determined until the next day.

Note2:  After a 2nd sleeper of 7and 1/4 hours the new 14 hours would restart at 2:00 PM.
